Action Alert: Urgent Calls Needed
​to Stop Pesticide Liability Shield

The chemical giants that profit from toxic pesticides and herbicides want to escape accountability from the harm they cause - and they're using Congress to do it. 

A provision has been quietly slipped into the Interior Appropriations bill that would give pesticide manufacturers immunity from lawsuits, even when their products devastate the farmer's crops, sicken farmworkers, or contaminate organic fields. 
The bill is scheduled for its first vote July 15, 2025 in the U.S. House Subcommittee on Interior and Environment.
It will be hard to impact this vote on such short notice; but we need to generate as many calls as possible so that all the Representatives -- both those voting this morning and those voting on this bill as it progresses -- know that their constituents are aware of what is happening and outraged by it.

"I strongly oppose Section 453 of the Interior Appropriations bill or any provision that shields pesticide companies from liability. Companies must be held responsible when their products harm farmers, workers and communities."

This action covers thousands of chemicals.
From household weedkillers to restricted-use agricultural pesticides, this legislation would apply across the board. It gives companies a free pass, even when they conceal risks or fail to warn about dangers — as long as their label was once approved by the Environmental Protection Agency (EPA).

The EPA doesn’t independently test these products — it relies on the companies.
Federal law allows pesticide manufacturers to submit their own safety studies. The EPA does not conduct its own testing and relies heavily on industry submitted studies. And when companies manipulate or withhold critical data — as they’ve done in the past — this bill would still protect them!

It gives total immunity to international corporations who have no accountability to Americans.
ChemChina — a state-owned company the Pentagon identifies as a Chinese military entity — owns Syngenta, which sells paraquat and hundreds of other pesticides in the U.S.  Bayer - the German-owned company that bought Monsanto -- has had to pay hundreds of millions in damages to people harmed by the chemicals, but that accountability will end with this bill.  Why are American farmers and families being prevented from recovering for harms these companies cause?

It protects companies that destroy farmers’ crops — even when they lied to get EPA approval.
If this bill passes, nothing would stop a company from pushing a new product they know is likely to drift and damage nearby fields. They could downplay the risks to the EPA, get a label approved, and leave neighboring farmers with scorched crops, lost yields, and no legal recourse. Even when livelihoods are wiped out, immunity means farmers would be stuck with the costs — not the companies who caused the damage.

Liability shields may sound good -- "stop the evil tort lawyers" is an attractive slogan -- but they have a fundamental problem. Once a for-profit company knows it can't be sued, all the incentives weigh in favor of lying to regulators and doing the bare minimum to get government approval from agency officials who are beholden to the industry.  This already happens far too much, we can't let it get even worse!
